Metropolis University
data breach!
Metropolis Uni staff
members use laptops provided by the Uni. The laptops change log on details
every three months as part of the Data Protection Policy for the University.
Angela and Kallie are
both members of the Law staff who decide to meet off site at a local café to
discuss student grades. Angela takes a staff laptop containing a spreadsheet of
all the student results including, names, emails, dates of birth and telephone
numbers.
Kallie has saved a
local copy of the same spreadsheet on her personal laptop, as it’s easier to
use and requires no password etc.
Following the
discussion, when all work is complete they decide to have a glass of wine to
celebrate a job well done. Angela leaves her laptop in her car overnight. Later
that night the laptop is stolen from the car.
Unfortunately Kallie
in a rush to get home, leaves her laptop on the train.
In spite of their
best efforts the pair are unable to recover the laptops.
A) Advise Angela, Kallie and Metropolis Uni
of their potential legal liability for the missing laptops and the data held
on it, making reference to the Data Protection Act and appropriate case
examples.
B) Advise Kallie of her liability in civil
law - specifically consider whether Metropolis could make a claim in negligence
against Kallie.
